1. Agreement to Terms

By accessing, using, or registering for Jungle Rebounder ("the Service", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Jungle Rebounder.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service after any modifications to these Terms constitutes acceptance of the modified Terms.

2. Eligibility and Age Requirements

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that:

• You are of legal age to form a binding contract
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable laws
• You are not located in a jurisdiction where cryptocurrency trading is prohibited
• All information you provide is accurate, current, and complete

If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

3. Service Description

Jungle Rebounder is an automated algorithmic trading platform that executes trades on Hyperliquid perpetual futures exchange using configurable trading strategies, including martingale-based approaches. The Service is designed as a tool for experienced traders who understand the inherent risks of automated trading and cryptocurrency markets.

Service Features:

• Dry Mode: Paper trading simulation that allows you to test strategies without risking real funds
• Live Mode: Real trading execution with actual funds on Hyperliquid exchange (Pro tier only)
• Web dashboard for configuration, monitoring, and analytics
• Telegram bot interface for notifications and basic controls
• Customizable signal templates and trading parameters
• Performance tracking and analytics

Third-Party Services: The Service integrates with Hyperliquid exchange and Telegram. Your use of these third-party services is subject to their respective terms of service. We are not responsible for the availability, performance, or actions of third-party services.

We reserve the right to modify, update, or discontinue any feature of the Service at any time with or without notice.

The Service is a technology platform and trading tool. It is NOT intended to provide financial, investment, legal, tax, or trading advice. Nothing in the Service, including but not limited to signal templates, default configurations, documentation, or communications, constitutes:

• A recommendation to buy, sell, or hold any financial instrument
• Investment advice or a solicitation to invest
• Financial planning or portfolio management advice
• A guarantee of profitability or performance

You should consult with qualified financial advisors, tax professionals, and legal counsel before making any investment or trading decisions. All trading decisions are your sole responsibility.

6. Account Registration and Security

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your account credentials (email, password, two-factor authentication codes)
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with any third party

We reserve the right to suspend or terminate accounts that provide false, incomplete, or misleading information, or that violate these Terms.

7. API Keys and Exchange Security

Your Responsibilities:

• You are solely responsible for the security and management of your exchange API keys
• You must use API keys with trading-only permissions (no withdrawal or transfer permissions)
• You must not share your API keys with any third party
• You must immediately revoke API keys if you suspect unauthorized access
• You must comply with your exchange's terms of service and API usage policies

Our Security Measures:

• We encrypt API keys using industry-standard encryption methods
• We store encrypted API keys securely and do not share them with third parties
• We implement security measures to protect against unauthorized access

Limitation: Despite our security measures, we are not responsible for losses resulting from unauthorized access to your API keys due to your own security practices, exchange security breaches, phishing attacks, or other factors outside our control.

8. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Engage in fraudulent, deceptive, or illegal activities
• Manipulate markets or engage in market abuse
• Interfere with or disrupt the Service, servers, or networks
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated systems (bots, scrapers) to access the Service without authorization
• Reverse engineer, decompile, or attempt to extract source code
• Resell, sublicense, or commercialize the Service without permission
• Use the Service to compete with or harm our business
• Transmit viruses, malware, or harmful code
• Impersonate any person or entity
• Collect or harvest information about other users

Violation of this section may result in immediate suspension or termination of your account and may subject you to legal action.

9. User Responsibilities

By using the Service, you agree to:

• Only trade with funds you can afford to lose completely
• Understand the risks of automated trading, leverage, and martingale strategies before using Live Mode
• Thoroughly test your configuration in Dry Mode before deploying real capital
• Monitor your positions regularly and not rely solely on automated trading
• Set appropriate risk limits, stop losses, and position sizes
• Comply with all applicable laws and regulations in your jurisdiction, including tax obligations
• Pay all subscription fees on time if you subscribe to the Pro tier
• Maintain accurate records of your trading activity for tax and regulatory purposes
• Not use the Service if you are prohibited from trading in your jurisdiction
• Report any bugs, errors, or security vulnerabilities to us

10. Subscriptions and Payments

Subscription Tiers:

• Free Tier: Access to Dry Mode (paper trading) only, available at no cost. No credit card required.
• Pro Tier: Access to Live Mode (real trading) and advanced features for a monthly or annual subscription fee as displayed on our pricing page.

Payment Terms:

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods, unused time, or after cancellation
• We reserve the right to change pricing with 30 days advance notice to existing subscribers
• Failure to pay may result in immediate suspension or termination of your Pro tier access
• You are responsible for any taxes, fees, or charges imposed by your payment method or jurisdiction
• We use third-party payment processors; your payment is subject to their terms

Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date. You authorize us to charge your payment method for renewal fees.

11. Intellectual Property Rights

The Service, including all content, features, functionality, software, algorithms, designs, logos, trademarks, and documentation, is owned by Jungle Rebounder and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes in accordance with these Terms. This license does not include the right to:

• Reproduce, modify, or create derivative works
• Distribute, sublicense, or resell the Service
• Reverse engineer or attempt to extract source code
• Remove or alter copyright or proprietary notices

All rights not expressly granted are reserved. Your use of the Service does not grant you ownership of any intellectual property.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We are not responsible for any trading losses, financial losses, or damages you incur, regardless of cause
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption
• We make no guarantees, warranties, or representations about the performance, profitability, accuracy, or reliability of the Service
• We are not responsible for technical failures, bugs, errors, service interruptions, or downtime
• We are not liable for losses caused by market conditions, exchange issues, network problems, or third-party service failures
• We are not responsible for losses resulting from your configuration errors, misuse of the Service, or failure to monitor positions
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater

Your use of the Service is entirely at your own risk. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Jungle Rebounder, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party rights; (d) your trading activities and decisions; or (e) any content or information you submit or transmit through the Service.

14. Service Availability and Modifications

We strive to maintain Service availability but do not guarantee uninterrupted, error-free, or secure operation. The Service may be unavailable due to:

• Scheduled or unscheduled maintenance
• Technical failures or bugs
• Third-party service outages (exchanges, cloud providers, etc.)
• Force majeure events
• Security incidents or attacks

We reserve the right to modify, suspend, or discontinue the Service or any part thereof at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

We may update, change, or remove features, functionality, or content at any time. We are not obligated to maintain or support any specific version or feature.

15. Account Suspension and Termination

Termination by You: You may terminate your account at any time by contacting us or canceling your subscription. Upon termination, your access to the Service will cease at the end of your billing period (for paid subscriptions) or immediately (for free accounts).

Termination by Us: We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms or our policies
• You engage in fraudulent, illegal, or harmful activities
• You fail to pay subscription fees
• We suspect unauthorized or fraudulent use of your account
• We are required to do so by law or regulatory authority
• You breach any applicable laws or regulations

Upon termination, your right to use the Service immediately ceases. We may delete your account data, but we are not obligated to retain it. Sections of these Terms that by their nature should survive termination will survive.

16. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. We implement security measures to protect your data, but we cannot guarantee absolute security.

17. Dispute Resolution

Informal Resolution: Before initiating formal proceedings, you agree to contact us to attempt to resolve any dispute informally. We will attempt to resolve disputes in good faith within 30 days.

Binding Arbitration: If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions, collective actions, or representative proceedings.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Jungle Rebounder operates, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of that jurisdiction, and you consent to the jurisdiction of such courts.

19. Force Majeure

We are not liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, exchange failures, network outages, or other force majeure events.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Jungle Rebounder regarding the Service and supersede all prior agreements, understandings, or communications.

22. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last updated" date
• Sending an email to the address associated with your account (for material changes)
• Displaying a notice on the Service

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.
